Fire code in West Virginia

West Virginia has adopted NFPA 1 (2021) with NFPA 101 (2021) (NFPA 1), effective May 1, 2024. The adopting authority is West Virginia State Fire Commission (Office of the State Fire Marshal). Verified June 28, 2026.

WV State Fire Code (87 CSR 1) is based on NFPA 1 and NFPA 101 (not the ICC IFC); both adopted in the 2021 edition with state additions. The rule in force is effective 5/1/2024; a refreshed rule effective 7/1/2026 retains the NFPA 1/101 2021 editions. Statewide minimum with local-option enforcement.

Not always. Many jurisdictions set a statewide or provincial baseline edition, but local building departments (the authority having jurisdiction, or AHJ) can amend it or enforce a different edition. Some states leave most adoption to local jurisdictions, and a few large cities such as Chicago and New York City run their own codes. Always confirm with your AHJ.
